These terms explain how Yarty creates, hosts and looks after business websites, how domains are managed, and what happens if either of us needs to end the service.

The short version: asking us to create a website to review is free and does not commit you to buying it. If you approve it, the build costs £199 and Website Care costs £9.99 per month for a minimum of 12 months. Your standard domain, hosting and essential technical care are included.

1. Who these terms are for

Yarty.website is a trading division of Ownercars Limited, a private limited company registered in England and Wales under company number 17257243, with its registered office at 128 City Road, London, England, EC1V 2NX. These terms form the agreement between Ownercars Limited, trading as Yarty.website (“Yarty”, “we”, “us”) and the business, sole trader, partnership, charity or organisation buying our services (“you”, “your” or “customer”). Our website services are offered for business or professional purposes.

By confirming in writing that you wish to purchase a website, paying our invoice or asking us to publish the approved website—whichever happens first—you accept these terms. A request for a free draft alone does not create a paid contract.

2. Draft websites

We may create a draft website using information that you provide and information about your business that is already publicly available. The draft is supplied for your private review and may use a temporary address such as your-business.yarty.website.

A draft is illustrative and may contain placeholder text, images, suggested wording or assumptions that require your approval. You must check names, claims, services, prices, qualifications, contact details and other factual content before publication.

We may withdraw or delete an unpaid draft at any time. You may not copy, publish, reproduce or commercially use an unpaid draft without our written permission.

3. Purchase, prices and payment

The standard price is £199 for the website build plus £9.99 per month for Website Care. We will tell you before starting if your requested features fall outside the standard service or require a separate quote.

The build fee is due when you approve the website and before it is published on your permanent domain. Website Care begins when the website is first published on your domain. Unless we agree otherwise, monthly payments are collected automatically using the payment method you authorise.

Prices include any applicable taxes unless the invoice states otherwise. We may change the monthly price after the initial 12-month term by giving at least 30 days’ written notice. You may cancel before a price change takes effect.

If payment is overdue, we may give you notice and suspend the website, support or domain management until the account is brought up to date. You remain responsible for charges accrued during the initial term.

4. What Website Care includes

Website Care covers the recurring technical services needed to keep a standard Yarty website operating:

  • managed website hosting;
  • registration or renewal of one eligible standard domain;
  • SSL/security certificate;
  • routine backups and technical maintenance;
  • reasonable technical support for faults affecting the website; and
  • reasonable monitoring and restoration following a technical failure.

Website Care does not include business email, ecommerce, advertising, search-engine campaigns, copywriting, photography, premium software, paid integrations, major redesigns, new pages or regular content changes unless we agree them separately.

5. Domains

Your permanent domain

Where included, we will register or manage one standard domain such as a normally priced .co.uk, .uk or .com, subject to availability and the rules of the relevant registry and registrar. Premium domains, unusually priced domains and specialist extensions are not included.

We will use reasonable efforts to record you or your business as the domain registrant or beneficial owner, with Yarty acting as the administrative and technical manager. You must provide accurate registrant information and keep it up to date.

Renewal

While Website Care is active and paid, we will pay the standard renewal fee and manage renewal. We are not responsible for a domain being lost because you supplied inaccurate information, did not respond to a registry verification request, disputed ownership, breached registry rules or failed to pay Website Care charges.

Transfer when you leave

After all outstanding amounts are paid, we will reasonably assist you in transferring your permanent domain to another provider. Third-party transfer or renewal fees are your responsibility. Temporary preview addresses and all yarty.website subdomains remain Yarty property and cannot be transferred.

In plain English: the preview may live on a Yarty subdomain, but the published site gets its own domain. Your permanent domain is for your business; Yarty simply looks after it while you subscribe.

6. Changes, revisions and support

The £199 build includes reasonable revisions needed to agree the initial website before publication. A “reasonable revision” adjusts the agreed content or presentation; it does not add substantial new pages, features or a different design direction.

After publication, correction of faults caused by Yarty and routine technical maintenance are included in Website Care. Content updates, new functionality and redesign work may be quoted separately. We will obtain your approval before carrying out chargeable work.

Support is provided through hello@yarty.website and by telephone during our normal working availability. Website Care does not guarantee an immediate or round-the-clock response.

7. Your content and responsibilities

You are responsible for checking and approving the website’s content and for ensuring that your business complies with laws and professional rules that apply to it. You confirm that:

  • information you give us is accurate and not misleading;
  • you have permission to use all names, logos, photographs, text and other materials you supply;
  • your content does not infringe copyright, trade marks, privacy or other rights;
  • your content is not unlawful, defamatory, discriminatory, fraudulent, harmful or obscene; and
  • you will promptly tell us when important information changes.

We may refuse or remove content that we reasonably believe is unlawful, unsafe, infringing or damaging to our systems or reputation. We may suspend a site immediately where necessary to protect customers, infrastructure or third parties.

8. Ownership and permission to use the website

You retain ownership of original content and branding that you supply. You give us permission to copy, adapt and publish that material only as needed to provide the services.

Once the build fee and all due charges are paid, you may use the finished website for your business while Website Care is active. Yarty retains ownership of its reusable layouts, code, tools, processes, know-how and any materials licensed from third parties.

Unless you ask us not to, we may identify your business and display screenshots or a link to the public website in our portfolio and marketing. We will not disclose confidential business information.

9. Term, cancellation and what happens afterwards

Website Care has an initial minimum term of 12 months starting when the website is published on your permanent domain. After that, it continues monthly until either party gives at least 30 days’ written notice.

You may ask to cancel at any time. If you cancel during the initial term, the unpaid Website Care charges for the remainder of that term remain due, unless we agree otherwise or the law requires a different result.

We may end the agreement on 30 days’ notice, or sooner if you materially breach these terms, use the service unlawfully, repeatedly fail to pay, threaten or abuse our staff, or create a security risk. Where a breach can reasonably be fixed, we will normally give you an opportunity to put it right.

When the service ends, we will stop hosting and maintaining the website after the agreed end date. At your request, and once all outstanding amounts are paid, we will reasonably assist with transferring your permanent domain and provide a practical export of customer-supplied content. Our reusable code, systems and temporary Yarty subdomain are not transferred.

Consumer rights

Our service is intended for business customers. If you nevertheless qualify as a consumer under applicable law, nothing in these terms removes your statutory rights, including any cancellation rights that apply to a distance contract. If you ask us to begin work during a statutory cancellation period, we may ask you to make that request expressly and you may have to pay for work properly supplied before cancellation.

10. Availability, security and third parties

We aim to keep websites reliably available, but no hosting, internet or domain service is uninterrupted or error-free. Planned maintenance, emergency work, cyber incidents and failures of registries, hosting providers, networks or other third parties may temporarily affect the service.

We will use reasonable care and skill, appropriate security measures and reasonable efforts to restore a service we manage. We do not guarantee search-engine rankings, visitor numbers, enquiries, sales or compatibility with every device, browser or third-party service.

Third-party products and services may have their own terms, availability and privacy practices. We are not responsible for changes made by a third party outside our reasonable control.

11. Liability

Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to that, neither party will be liable to the other for indirect or consequential loss, or for loss of profit, revenue, business, opportunity, goodwill or anticipated savings. Yarty’s total liability arising from the services in any 12-month period will not exceed the total fees you paid to Yarty during that period.

You are responsible for keeping independent copies of important business information and for checking the site before relying on it. These limitations apply only to the fullest extent permitted by law.

12. Privacy notice

Information we collect

We may collect your name, business name, town, email address, telephone number, billing and payment status, correspondence, website content, domain details and technical information needed to provide and secure the service. Payment-card details should be handled by our payment provider rather than stored directly by Yarty.

How and why we use it

We use personal information to respond to enquiries, prepare draft websites, enter into and perform contracts, collect payment, register and manage domains, provide support, secure our services, keep business records and comply with legal obligations. Depending on the activity, our lawful basis will usually be steps requested before a contract, performance of a contract, legal obligation or our legitimate interests in operating and improving the business.

Who receives it

We may share the minimum necessary information with trusted hosting, domain-registration, email, payment, analytics, professional-adviser and technical-support providers. We may also disclose information where legally required. We do not sell personal information.

How long we keep it

Enquiry information that does not lead to a customer relationship will normally be deleted or anonymised within 12 months. Contract, invoice and transaction records are normally retained for up to seven years after the relationship ends. Website and support data is retained while needed to provide the service and for a limited backup period afterwards.

Your rights

Depending on the circumstances, you may ask for access to, correction or deletion of your personal information; object to or restrict its use; or request portability. You may complain to the UK Information Commissioner’s Office at ico.org.uk. Contact us first at hello@yarty.website so we can try to resolve your concern.

Cookies

The main Yarty website is designed to work without non-essential tracking cookies. If analytics, advertising or other non-essential cookies are introduced, we will update this notice and provide any consent controls required by law.

13. General terms

We may update these terms for future customers at any time. For an existing customer, we will give reasonable notice of a material change that affects the service. A change will not retrospectively alter fees already paid or remove accrued rights.

Neither party is responsible for delay caused by events beyond its reasonable control. If one part of these terms is unenforceable, the remaining parts continue. A delay in enforcing a right does not waive it. You may not transfer the agreement without our written consent; we may use carefully selected suppliers to provide parts of the service.

These terms and the written order or invoice form the whole agreement. If they conflict, a specific written quotation or order agreed by both parties takes priority for that service.

The agreement is governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction, subject to any mandatory legal rights that apply.
